thanks, does it have to be working for certain years on H1 to be eligible for in-state fee ? Or fresh H1 (H4) will be eligible ?

fresh is eligible. Check schools website, they should have listed.

No buddy I am not sure about fresh H1, H1 have to have paid the taxes in that state that is the only proof you need.
