Today we had a seminar in our school for TPS so i want to share few things with you all.

- F1 students can apply for TPS but yet has to maintain 12 credit hours for under grad and 6 hours for grad students.
- F1 students can apply for TPS and EAD but can not use the EAD since it will be violation of F1 Status. (some other countries were given facility in tps where F1 students could work but Nepal has not been granted facility to work for F1 using TPS EAD card).
-Those people who are about to graduate or are in opt can apply for TPS only .( dont apply both opt ead and tps ead. Best is just to apply OPT EAD)
- TPS status and OPT F1 status goes in parallel ( i.e you are in both status)
- (Why tps only, why not apply TPS EAD)
Apply tps only so that in case you did not find job after 90 days of applying for opt or get fired and did not get job for months then your status will be protected by TPS. you might loose F1 status but yet you will have a legal status which is TPS. You can go back to F1 again staying in TPS status which means you wont be illegal.


These are the things i came to know in todays seminar... i am not a lawyer or anything just passing some information.

---True, but if you are graduating in 2017, 2018, then you can apply for TPS RAD and work.

according to the attorney

I have no idea where it says but this is according to the attorney

Sorry, I misread and there was no both on the first post. You are right, don't apply for both EAD.

Hi MimroRaMero,

Could you tell me if you have any idea about students who are on OPT and expires on Feb, 2016 then what is the best time to apply for TPS with EAD (since the average processing period is 3 months or so) cause I am also planning maintain my F-1. If I get my EAD through TPS in Jan or Feb then will I have only 60 days to transfer my SEVIS? Any suggestions will be appreciated.

Hey guys, if the school you are talking about is uta, don't believe a crap they are telling you. There are a bunch of racist people in their international office. They dont care about foreign students. They hate them. Trust me, they will cook up all kinds of lies. They just want money. They make all kinds of nasty and ridiculous rules and regulations to make peoples life harder because they are racist. So please don't believe a word their so called " lawyer" has to say about Nepalese people or tps. Hell we don't even need to tell them they we are applying or applied for tps or work authorization. Is not their business. They are not immigration officers. Just crooked business people

I don't know how long the EAD validity will be, I guess it will be for 1 year, and they might allow to renew after that. So you can apply for TPS and EAD now and just get your TPS EAD and start working on it, while maintaining your F1 status. If they extend the TPS then you will be able to renew your EAD.

IMO,
if you are graduating on Dec'15 or May'16, apply for TPS and OPT EAD. If you are unable to make change of status to H1B within the timeframe apply for TPS EAD later.

if you are graduating on Dec'16 or later, apply for TPS only or TPS with EAD if you really need it now. the reason for only applying for TPS is once you use EAD through TPS, it's most likely you will violate your F1 status though there is a provision for reinstatement.

@mimroramero

I really appreciate your time and suggestions. I am planning to apply in mid November or 1st December because I am planning to join college in April or May 2016. I guess, it will most probably help me to get my EAD through the TPS in Jan or Feb and my OPT will expire in Feb. So, I can work continuously and maintain my status as well. If I apply now I have to go to college within 60 days (after I get my EAD through TPS approved) and I am not ready for that. Does it make sense? If you have a better idea then let me know :).

@goodtogo, I like the way you are planning. That way you can continue your work, and even after you go to school you can work full time. Just don't forget to maintain your F1, and the same time any company could sponsor you for H1B on your TPS EAD.

Ps. If your OPT EAD expires before your TPS EAD gets in your hand, I don't think that will be a problem, because you will have 2 months to join the college.

Ps1. Or you can apply for TPS only this time, and apply EAD later in Nov or Dec. It's up to you. That way you can apply your EAD whenever you want.

Actually, I thought of applying TPS now and EAD in early Jan 2016 but I am confused whether I need to go to school within two months or not after getting my TPS approved but my OPT will still be valid? Or is it a good idea to apply separately/ will it affect any approval decisions. :(

If your OPT is still valid, you don't have to go to school. After TPS approves, it does not affect your F1 status, you can just be a student. Applying separately does not affect the decision, I guess. Why would it affects?

In every answer you posted you are saying "according to attorney" "according to attorney"........ boro they dont know everything....immigration is a very complex and its huge like a pacific ocean....we must rely only to the attorneys who have actually have worked in such cases....lemme give you and example....if you are filing for a asylum and you come with a knowledge from a lawyers somewhere from North dakota instead of the ones from California or New york...then that would be the worst lawyer to talk to...and you would be the stupidiest person to quote his knowledge...first of lawyers will never say that they dont know about it......they will just tell as if they have handled the case.....there could be hundreds of thousands of attonerys who have never sniffed a TPS case....All i am saying is Lawyers are not expert in all types of cases......Another Example: An immigration lawyer from Hartford connecticut has better chance of handling a TPS case than from one in Wisconsin........why?... coz thousands and thousands of Haitian folks have resettled there after the earthquake........So folks take advice from expert lawyers who have actually handled the case.....deciding solely on one person's advice is a huge mistake.

Hi @mimroramero ,

Do you know any good lawyer? Cause I talked to few of them, California ones but as you said I did get different answers for the same questions.

To be honest, I haven't done anything through Lawyer. I can't say which one is good, but there are some that I know.
The one from the BSU (video somewhere), she sounds knowledgeable.
