Dear Friends My company is ready to sponsor me H1b Visa but the problem is that I will be graduating only in may, so I will not have diploma for H1b application. I was wondering whether the university letter about convocation date will work,. But the university is ready to give me transcript before april 1st. Will the transcript gona work. Thanks

missingnepal, The question is not if you can use transcript instead of diploma but whether you have enough credits to graduate before April 1, day when H-1 is filed. What this means, if you are an undergraduate, is that technically you could have graduated last semester given the requirements of your major and even if you fail all your classes this semester, you should still have an undergraduate degree. If you are doing a graduate degree, then what I have said won't apply as you already have a bachelor's degree and can apply anyway.

Do I need another letter in addition to transcript, that says all the requirement for the degree has been completed. Cause transcript does not say anything about graduation requirement? It just lists all the courses with the grades?

I guess, if you have already finished your credits before April and only your Graduation is on May, then you are all right. Just have a transcript and a letter stating that you have completed your course requirement before April. You can have that letter either from the International Student office or your Advisor or Incharge of the person who is responsible for your academic records. In that letter, it should be clearly stated that you had completed your degree requirement before April. But if you are only completing all the degree requirement in the May and applying for H1B in April then think 10 times before doing that. Now-a-days, USCIS is being very strict especially about H1B so do not try to submit any fraud thing while filing your H1B.

Dear Friends Thanks for giving such an important informations to me, I am sure the above informations were helpful to lot of other Nepalis who are in situation like me. About me, I am graduate student, just waiting for convocation on May. All my documents are very genuine and even the job is very decent. Once again thanks to all. Any more suggestions are welcome. Just heads up for those who are submitting a university letter instead of diploma: You need to get a letter from the Registrar saying you have met all the requirements for graduation. No international student office letter or DSO letter, no department letter and no letter from your advisor will work. It has to be from the registrar's office. Otherwise your application won't be accepted!
